There are several different types of employment law claims which our law firm handles.  These categories include wage claims, wrongful termination claims and benefit claims.
 

Wage Claims
I.   State Wage Claims
     Weldy and Associates is one of the premiere law firms prosecuting state wage claims for employees.  We have been extremely active on the appellete level expanding the rights of employees to pursue various types of wage claims.  There are two types of wage claims (1) Ten Day Rule claims and (2) failure to pay regular, vacation, commission or bonus wages.

     A.   Ten Day Rule Claims
               Indiana law requires that an employer pay all wages earned within 10
      business days.   Thus below is how the different types of wages must be paid.
            1.   Regular Wages - within 10 business days of the pay period ending
            2.   Commission Wages - within 10 business days of the commission
            period ending if commissions are calculated on a bi-weekly or monthly    
               basis OR within 10 business days from the sale or sale finalization as 
               agreed by the employer.
            3.   Bonus Wages - within 10 business days of the end of the period 
               which the bonus was calculated.

     B.   Failure to Pay Wages Timely
           Many employers fail to pay final wages timely following separation of 
     employment.  Under Indiana law, all wages due and owing must be paid on the 
     pay date for the pay period in which separation of employment occurred.  We
      have found that the following wages are often paid late by employers - 
      (1) vacation wages, (2) personal time and (3) commissions.
